Contract Disputes

The purpose of having a written contract is to avoid disputes by detailing the terms and conditions of the parties agreement.  Nevertheless, even when contracts are drafted with the proper amount of detail, disputes and arguments invariably arise.  Sometimes those disputes can be resolved without resorting to litigation.  Other times they cannot and litigation becomes necessary.  Whatever the case may be, it is always a good idea to have quality representation.

Business Disputes

Business disputes arise in almost every setting.  Sometimes businesses have disputes with other businesses regarding the quality of a product or the performance of a service.  Other times members of a business may have a dispute about the operation of the business or the conduct of its members.  When those situations arise, it is always best to have a competent legal representative who can offer advice and counseling or provide representation should litigation become necessary.

Real Estate Partition

Frequently, real estate may be owned by more than one owner.  Sometimes, co-owners buy property with a common goal, but later problems arise which may cause a dispute among the co-owners.  In those situations, Colorado law provides a mechanism to partition or divide the property between co-owners, if possible.  If that is not possible, the property may be ordered sold with the proceeds divided and shared between the co-owners.

Commercial Lease Disputes

Commercial lease disputes can arise in various forms.  Many times a landlord and tenant may disagree about a lease provision.  More likely, a tenant may wish to terminate a lease early, perhaps because of a downturn in business.  In those situations, a landlord and tenant may negotiate a way for the tenant to leave on mutually agreeable terms.  If that cannot be done, litigation sometimes becomes necessary.  In either case, it is important to have competent representation.

Real Estate Disputes

Real estate disputes often arise between co-owners or buyers and sellers.  Many times co-owners disagree about the use of a piece of property, whether to sell it, or on the terms of a potential sale.  Sometimes title issues arise which must be addressed.  Whether resolved by agreement or through litigation, care should be taken when drafting any new deeds, deeds of trust, promissory notes, etc. which may become necessary after the resolution of such issues.

Landlord/Tenant Disputes

Landlord/tenant disputes may arise and typically, these disputes involve rent payments, the condition of the property, repairs, or alterations to the property.  Colorado now has a Warranty of Habitability requiring all residential rentals to be fit for human habitation and free of materially dangerous or hazardous conditions to the tenant’s life, health or safety.
